Terms of Service

1. Acceptance and eligibility
These Terms of Service govern your access to and use of APOS, the Advantage Player Operating System. By creating an account, starting a trial, purchasing a membership, or using APOS, you agree to these Terms.
You must be at least 18 years old and legally able to enter into these Terms. You are responsible for complying with the laws and rules that apply to you, including casino, gaming, travel, tax, employment, and data laws in your jurisdiction.
2. What APOS is
APOS is a private software workspace for recordkeeping, planning, research, analysis, and operational organization related to advantage play. APOS does not operate a casino, accept wagers, place bets for users, provide gambling funds, guarantee access to any casino, or guarantee any gambling or financial result.
Information in APOS is provided for organizational and informational purposes. You remain responsible for your own decisions, play, travel, finances, compliance, and risk management.
3. Accounts and security
You must provide accurate account information and keep your login credentials secure. You are responsible for activity performed through your account unless you promptly notify APOS of unauthorized access.
APOS may use security controls, rate limits, verification tools, inactivity timeouts, and other safeguards to protect accounts and the service.
4. Trial and memberships
New eligible accounts receive a 7-day full-access trial. No credit card is required to begin the trial. Selecting or purchasing a membership during the trial does not shorten the 7-day trial.
Monthly and Annual memberships are recurring subscriptions. When selected during an active trial, recurring billing begins when the trial ends. Recurring memberships may be canceled through the Stripe billing portal and remain subject to the billing-period terms shown at cancellation.
Lifetime is a one-time membership purchase. A Lifetime payment may be completed during the trial; the trial still continues for its full duration while the Lifetime membership is confirmed for continued access afterward.
5. Founding Lifetime memberships
APOS offers a limited commercial Founding Lifetime program for the first 100 successfully paid commercial Founding Lifetime memberships. A Founding spot is not secured merely by selecting Lifetime. APOS may place a short temporary checkout hold on an available number, but the numbered Founding membership is confirmed only after successful payment.
Founding Lifetime members receive numbered Founding Member recognition while their Founding status remains in good standing. Commercial Founding numbers are sequential. If a commercial Founding member later forfeits or loses Founding status, each higher commercial Founding number moves down by one so the sequence remains continuous. A member's displayed Founding number may therefore decrease over time, but an earlier member will never be moved behind a later member.
When the 100 commercial Founding memberships have been successfully claimed, Lifetime may remain available at the regular Lifetime price without Founding status or a Founding number. If a commercial Founding position later returns to the pool, Founding availability may reopen subject to the then-current APOS offer and pricing.
6. Prices, currency, taxes, and billing
Current membership prices are displayed by APOS before checkout. APOS may offer pricing in supported currencies, including USD and CAD. Applicable taxes may be added at checkout or billing where required.
Payments are processed by Stripe. Your use of Stripe-hosted checkout or billing features may also be subject to Stripe's applicable terms and privacy practices.
APOS may change prices for future purchases or future billing periods. A price change does not retroactively alter a completed Lifetime purchase or a confirmed Founding membership.
7. Refund policy
Founding Lifetime and regular Lifetime purchases are one-time purchases and are non-refundable, except where a refund is required by law or expressly approved by APOS. APOS does not offer a routine customer refund program for Lifetime purchases.
If APOS exceptionally approves any refund, partial or full, for a Founding Lifetime purchase, the member immediately forfeits Founding Member status. The forfeited position returns to the commercial pool and all higher commercial Founding numbers are re-sequenced downward by one. A full refund of a Lifetime purchase also terminates Lifetime membership access.
Recurring subscription charges are handled according to the applicable subscription, cancellation, mandatory consumer-law, and payment-network requirements. Canceling a recurring membership is not the same as requesting a refund.
8. User content and data
You retain ownership of the records, notes, files, journal content, imported data, and other content you provide to APOS. You grant APOS the limited rights necessary to host, process, back up, secure, and display that content for operation of the service.
You are responsible for ensuring that you have the right to upload or import content. Do not upload content that is unlawful, infringes another person's rights, or violates contractual or licensing restrictions.
9. Third-party products and information
APOS may interoperate with or reference third-party products, services, publications, or data sources. Third-party names and trademarks belong to their respective owners. Unless expressly stated, APOS is not affiliated with, endorsed by, or sponsored by those third parties.
Users are responsible for maintaining any licenses or lawful access required for third-party materials they import, including supported CBJN or CVCX-derived materials.
10. Acceptable use
You may not attempt to bypass security controls, access another user's data, disrupt the service, reverse engineer restricted components except where permitted by law, use APOS to distribute malicious code, or use the service for unlawful activity.
APOS may suspend or terminate access where reasonably necessary to protect users, data, service integrity, legal compliance, or the rights of APOS or others.
11. Availability and changes
APOS may add, modify, improve, suspend, or discontinue features. APOS does not guarantee uninterrupted or error-free operation, although reasonable efforts are made to maintain availability, security, and data integrity.
12. Disclaimer and limitation of liability
To the maximum extent permitted by law, APOS is provided on an 'as is' and 'as available' basis without guarantees of gambling results, profitability, casino access, data-source accuracy, or fitness for a particular advantage-play strategy.
To the maximum extent permitted by law, APOS and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost winnings, gambling losses, lost profits, casino actions, travel losses, or decisions made using the service. Nothing in these Terms excludes liability that cannot legally be excluded.
13. Governing law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise.
14. Changes to these Terms
APOS may update these Terms from time to time. Material changes will be reflected by an updated effective date and, where appropriate, additional notice. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
